Agreement to Terms
By engaging WebConfigr Inc. for any service — whether through our website, email, phone, or any other channel — you agree to be bound by these Terms of Service. These terms apply to all clients, visitors, and anyone who interacts with our services.
If you do not agree with any part of these terms, you should not engage our services. We reserve the right to update these terms at any time; continued use of our services following any change constitutes acceptance of the updated terms.
Services Provided
WebConfigr Inc. provides digital services including but not limited to:
- Custom website design and development
- eCommerce setup and optimization
- SEO and analytics infrastructure
- Payment system integration
- Social media management
- Site maintenance and updates
- Digital strategy consulting
The specific scope of services for each engagement will be defined in a project agreement or proposal provided to the client prior to work beginning. Any work outside the agreed scope may be subject to additional charges.
Payment Terms
Payment terms are established on a per-project basis and outlined in each project agreement. Generally:
- A deposit (typically 50%) may be required before work begins on larger projects
- Remaining balance is due upon project completion and before final delivery of files
- Smaller projects may require full payment upfront
- Ongoing retainer services are billed monthly in advance
Late payments may result in work being paused until the balance is settled. We accept payment via bank transfer, major credit cards, and other methods specified at the time of engagement.
All prices are in US dollars unless otherwise stated. Prices are subject to change; any changes will be communicated before work begins.
Client Responsibilities
For us to do our best work, clients are expected to:
- Provide all required content (text, images, logos, credentials) in a timely manner
- Review and provide feedback within agreed timeframes — delays on the client's end may affect delivery timelines
- Ensure all materials provided are owned by the client or properly licensed for use
- Designate one primary point of contact for the project
- Not share login credentials, staging links, or proprietary project details with unauthorized third parties
WebConfigr Inc. is not responsible for delays caused by the client failing to fulfill these responsibilities.
Intellectual Property & Ownership
Upon receipt of full payment, clients receive full ownership of the final deliverables created specifically for their project (e.g., custom code, design files, written content produced by WebConfigr).
WebConfigr Inc. retains the right to display completed work in its portfolio and marketing materials unless the client explicitly requests otherwise in writing.
Third-party tools, libraries, plugins, or licensed assets incorporated into a project remain subject to their respective licenses. The client is responsible for maintaining any required third-party licenses beyond the project period.
WebConfigr Inc. retains ownership of any pre-existing tools, frameworks, or methodologies used in the delivery of services.
Revisions & Scope Changes
Each project includes a defined number of revision rounds as outlined in the project agreement. Revisions are understood to mean minor changes to an approved design or content — not fundamental redesigns or changes to project scope.
Requests that fall outside the agreed scope will be quoted separately and require written approval before work proceeds. We'll always communicate clearly before charging for anything outside the original agreement.
Cancellation & Refunds
Either party may cancel a project with written notice. In the event of cancellation:
- Work completed up to the cancellation date will be invoiced at the agreed rate
- Deposits are non-refundable if work has already begun
- If WebConfigr cancels a project without cause, any deposit paid for work not yet started will be refunded in full
Refunds for completed work are not provided. If you have concerns about quality, we ask that you communicate them promptly so we can address them within the revision process.
Limitation of Liability
WebConfigr Inc. is not liable for any indirect, incidental, special, or consequential damages arising from the use of our services, including but not limited to loss of revenue, loss of data, or business interruption.
Our total liability in connection with any project shall not exceed the total fees paid by the client for that specific project.
We are not responsible for third-party services, platforms, or tools recommended or integrated as part of a project (e.g., hosting providers, payment processors, domain registrars).
Confidentiality
We treat all client information — business data, credentials, financial information, and strategic plans — as strictly confidential. We do not share, sell, or disclose client information to third parties except as required to complete the project (e.g., third-party integrations specifically requested by the client).
Clients are similarly expected to keep proprietary tools, templates, or methodologies shared by WebConfigr confidential and not reproduce or share them with competitors or unauthorized parties.
Governing Law
These Terms of Service are governed by the laws of the State of New York, United States. Any disputes arising from or related to these terms or our services shall be subject to the exclusive jurisdiction of the courts located in Erie County, New York.
